Thai News Pix Image Usage Rights


Thai News Pix (hereinafter referred to as "TNP") sets forth the following terms and conditions for the use of its editorial images by the Licensee:


1.Definitions


"Licensee": Refers to the individual or entity that has been granted the right to use the editorial images from TNP.

"Editorial Image": Refers to a photograph that captures a real-world event, news, or situation, and is intended to provide information to the public.

"Commercial Use": Refers to any use of the image for commercial purposes, including but not limited to advertising, promotion, use on merchandise, and use as part of marketing materials.

"Print Media": Refers to any form of printed publication, including but not limited to newspapers, magazines, journals, books, brochures, and other printed materials.

"Social Media Platforms": Refers to any online platform where users can create, share, and interact with content, including but not limited to Facebook, Twitter, Instagram, LinkedIn, and other platforms as defined by TNP.

"Same Editorial Context": Refers to content with the same core subject matter and intended purpose of conveying information, and published in the same media.


2.Rights of Use


All editorial images remain the copyright property of TNP and/or the contributing photographer. The Licensee is granted a non-exclusive right to use the images for editorial purposes only. Commercial use is prohibited unless expressly authorized in writing by TNP and/or the contributing photographer.


3.Scope of Use


The Licensee may use the licensed editorial images on the Licensee's websites, social media platforms, print media, and other digital media.

Unless otherwise agreed, the Licensee may use the editorial images an unlimited number of times within a period of 12 months from the date of purchase, provided that the use is within the same editorial context. Any use of the images in a different editorial context shall constitute a new use, and requires a separate license from TNP.

Upon the expiration of the 12-month period, the Licensee must cease all use of the editorial images and permanently delete them from their systems.


4.Image Alterations


The Licensee may resize, crop, or use the editorial images as part of graphic designs, provided that the essential elements of the image, such as individuals, locations, or events, are not altered or modified in a way that may lead to misunderstanding of the facts or distort the meaning of the image.


5.Credit Line


The Licensee must provide credit to the image creator each time the image is used, in the following format: “Photographer Name / Thai News Pix” or “Thai News Pix”. The credit line must be clearly visible either within the image or in the image caption. In the event that the medium has limitations on credit line display, the Licensee must provide credit in an alternative format as approved by TNP.


6.Prohibitions


The Licensee is prohibited from using the images for any commercial purposes, including but not limited to advertising, promotion, use on merchandise, or use to generate direct revenue, without obtaining prior written consent from TNP.


The Licensee is prohibited from using the editorial images in conjunction with any content that is factually inaccurate, misleading, or defamatory, or that may cause damage to the reputation, honor, privacy, or other rights of any individual depicted in the image.

The Licensee is prohibited from modifying, altering, or changing the editorial images in any way that may violate the moral rights of the photographer or misrepresent the facts of the event or situation depicted in the image.

The Licensee is prohibited from using the editorial images in any work that violates any applicable laws, public morals, or legal prohibitions.


7.Infringement


In the event of any unauthorized use of the editorial images, TNP will take the following actions:

  1. TNP will notify the Licensee of the unauthorized use and provide the Licensee with a period of 7 days from the date of notification to rectify the situation.
  2. If the Licensee fails to comply with the notification within the specified period, TNP will suspend the Licensee's access to use any images from TNP.
  3. TNP reserves the right to pursue all available legal remedies, including seeking monetary damages to the fullest extent of the law.


8.Governing Law and Dispute Resolution


These Terms and Conditions shall be governed by and construed in accordance with the laws of Thailand.

Any dispute arising out of or in connection with these Terms and Conditions shall be resolved through arbitration in accordance with the Arbitration Laws of Thailand.


9.Miscellaneous


TNP reserves the right to modify these Terms and Conditions at any time without prior notice. The Licensee is responsible for reviewing the latest version of the Terms and Conditions on the TNP website prior to using the images.
